i can't sue for peace while actively dying

im in 2 front war, all my vassals are captured, i have one castle left after vlandia cane with the 2000 men army and took my city , and i cant make peace even i i want to pay tribute. Can you recruit Lords from castle dungeon?

So, I'm thinking of starting my own kingdom but I'll need Lords. I currently have 3 in my dungeon that I had captured but their faction was wiped before they could get ransomed.

If I start my kingdom can I recruit them from my dungeon?
