Can u get executed without character death disabled?

Hi guys! I am new here, and was starting my first playthrough as a sturgian. I have been having a blast, but before i go chopping heads i saw a video of a guy getting executed and his run ended. I have character death off, so as far as im concerned i can't die in battle. But some people are peskering me to separate their heads from their bodies. But i don't want my own head getting lost. So i was wondering, can you get executed with player death disabled? Or do they always take you prisoner?
