Taking lords prisoner?

Have not played since war sails first released. What’s up with taking lords prisoner now? Before when you’d defeat a party it aways gave you the option, now it seems like half the time they just slip away somehow. Not sure when the oldest someone can die from old age is but I'm pretty sure that's what happened here. I don't think I've seen anything like it.
